We have successfully represented clients in investigations conducted by the Malaysia Competition Commission (MYCC). Additionally, we have successfully opposed judicial review applications at the High Court on behalf of our clients and our experience also extends to ongoing matters before the Court of Appeal.

In May 2023, our firm was recognized as an Impact Case Award winner by the Benchmark Litigation Asia-Pacific Awards 2023 for our role in one of Malaysia’s first cartel investigations. We successfully defended four general insurers in a high-profile cartel investigation involving the General Insurance Association of Malaysia (PIAM), with proceedings currently pending before the Court of Appeal.

The insurance team is headed by Tunku Farik who has vast experience of over 30 years in insurance litigation and arbitration, which has included international arbitration between insurer and reinsurer. Tunku Farik has appeared as lead counsel at the Court of Appeal and Federal Court levels in Malaysia, many of which are landmark cases that have been documented in Malaysian law reports. Tunku Farik has previously been Chair for the insurance committee of the Inter Pacific Bar Association (IPBA) and he has also given talks on various aspects of insurance litigation and also at seminars organised by Lexis Nexis Malaysia.

The firm has had a deliberate policy of specialising in Insurance Law which includes Reinsurance, Takaful (Islamic insurance) and Retakaful (Islamic reinsurance) and the servicing of Insurance and Reinsurance companies.

Due to the liberalisation of the Malaysian financial sector which includes insurance, more licenses can be expected to be issued by the central bank to foreign players especially in takaful (Islamic insurance). Foreigners will also be allowed to own up to 70% (from the previous 49%) of equity in insurance companies and takaful operators. The firm having the benefit of insurance industry experience and a corporate department is able to help in the due diligence and the drawing up of any agreements that may involve a foreign partner in a Malaysian insurance company.
